我国现行反黑社会性质组织的立法,提供了严厉打击涉黑犯罪的基本框架,并在迄今为止的两次“打黑除恶”专项斗争中发挥了重要作用。 然而,由于涉黑犯罪的复杂性和有关立法、解释的不足,加之学术界进行相关研究的起步较晚,在理论和司法实践上,仍然存在一些困惑和争议,有的甚至影响到对黑社会性质组织的打击力度。
